The use of the services or purchase of products through www.bibashops.com implies acceptance of the following general conditions.

- Description of Products and Services
Use of the website www.bibashops.com does not require prior registration, although registration is necessary to make purchases and manage orders.
TRANSPORT
The transportation of purchased items will be carried out through the shipping service contracted by UNITED BAGS COMPANY, S.L. (owner of the Online store bibashops.com). Delivery times will adjust according to stock availability and the shipping method and destination country selected.
Our courier service will deliver your items from Monday to Friday to the delivery address provided when placing the order.
Delivery times, from the moment the package leaves our warehouse, will depend on the destination and range between 1 – 10 working days.
Order tracking will be carried out by sending an email from the shipping service, or by contacting Customer Service. In this email, you will be informed at all times of the location of the goods until final receipt by the customer.
The shipping cost is calculated according to the destination country, the volume and weight of the purchased items, and the packaging used for shipment. The exact shipping cost will be calculated as each item is added to the shopping cart and will appear on the checkout page before confirming the order via “Confirm Order” and before entering your credit or debit card details.
Customs costs are the responsibility of the recipient, who must pay import charges to receive the order. If the recipient refuses to accept delivery in order to avoid import charges, the package will be returned to the local customs office, not to us. If the fees are not paid on time, the package will be considered abandoned and no refund will be given in this case (abandonment).

Product Return Policy
In addition to the legal right of withdrawal recognized by applicable law, the customer has a commercial period of 30 calendar days from the date of delivery of the product to request an exchange or return. The delivery date of the order will be used as a reference.

Returns or exchanges can be made free of charge at any of our stores. In case of a return, the amount will be refunded later from the central office, and never at the store itself.
- By mail or courier
The customer must bear the direct costs of the return, such as shipping fees.
Customs and import taxes
Any costs arising from customs duties or import taxes are the responsibility of the recipient. If the customer refuses delivery for this reason, the package may be returned to the sender. In this case, the product price will be refunded, with possible deduction of shipping, return, and, where applicable, customs handling costs.
Condition of returned products
- Products must not have been used, washed, or damaged, except for reasonable handling necessary to check the nature and characteristics of the product.
- Original tags must be attached.
- Include, if possible, a copy of the invoice or any other proof of purchase.
- The customer may, if desired, include a note explaining the reason for the return.
Refund
Once the product is received and checked to meet the above conditions, a refund will be issued within a maximum of 14 calendar days, using the same payment method used for the purchase, unless otherwise expressly agreed.

Legal right of withdrawal
In accordance with current consumer protection regulations, the customer has the right to withdraw from the contract within 14 calendar days from receipt of the order, without having to justify the decision, under the legally established terms and conditions.
Purchase Procedure
Items to be purchased must be selected and added to the shopping cart by clicking the corresponding button (‘Add to cart’).
The shopping cart will display the item reference, name, and price (including taxes). ATTENTION: The displayed price does not include shipping costs, which may vary depending on the destination country.
The order form will request personal, billing, and shipping information, which will be processed in accordance with our Privacy Policy to fulfill the order and manage the customer relationship. The customer also has a private area called ‘My Account’ to view and edit their information, access order history, and track orders. The customer is responsible for providing accurate data to avoid delivery issues.
Once the order is completed, a summary showing the items, total price (including shipping and taxes), and shipping details will be displayed. The order will be considered confirmed upon clicking the “Confirm Order” button.
Payments can be made by credit or debit card (Visa and MasterCard), PayPal, or bank transfer to the account provided during the checkout process. Only the payment methods available on the website at the time of purchase will be accepted. For card payments, the charge will be made in real-time through a secure payment gateway.

CUSTOMS

Currency, taxes, and payment methods

Taxes Prices include the taxes applicable based on the delivery country: - European Union (EU): VAT applicable to the destination country will be applied. - Canary Islands, Ceuta, and Melilla: prices are shown without VAT; local taxes must be paid upon delivery. If the shipment is refused due to non-payment of these taxes, the shipping cost will be deducted from the refund. - Rest of the world: applicable import duties and taxes of the destination country must be paid by the customer upon receipt of the goods.

For Visa, MasterCard, and American Express cards, the CES (Secure Electronic Commerce) system is applied through the 3D Secure protocol, identified by Verified by Visa and MasterCard SecureCode logos. This system automatically verifies that the card is enabled for Secure Electronic Commerce and requests authorization from the issuing bank via a personal code. The transaction will only be processed if the bank confirms the authorization; otherwise, it will be declined.

Responsibility and Guarantees in Our Products
The legal warranty for all our products is governed by the consumer protection regulations applicable in the customer’s country of residence. UNITED BAGS COMPANY, SL will at all times respect the statutory rights granted to consumers under the applicable legislation.
For sales within the European Union, new products are covered by a minimum legal warranty period of 3 years from the date of delivery. During the first 2 years, any lack of conformity shall be presumed to have existed at the time of delivery, unless proven otherwise. From that point until the end of the third year, the consumer must prove that the defect is of origin.
For customers outside the European Union, the warranty shall be applied in accordance with the legislation in force in the consumer’s country of residence or destination.
In the event that a product presents a lack of conformity or manufacturing defect, UNITED BAGS COMPANY, SL shall assume the corresponding legal responsibility, proceeding, where appropriate, with repair, replacement, price reduction, or refund, in accordance with the applicable legislation.
If the item is defective, damaged, or there has been a shipping error, the customer may return it to any of our stores or send it to our warehouse. Once the issue has been verified, the appropriate refund will be processed, including, where legally applicable, shipping and return costs.
Return shipping costs will only be reimbursed under the following circumstances:
1) The item is defective.
2) A shipping error has occurred.
3) The item does not match the images displayed on the website.
4) The order was delivered outside the timeframes set out in our General Terms and Conditions of Purchase.

User Responsibility

Our right to change these terms

However, the price and other conditions of the items that you have requested from us will not be modified during the period of time between your offer and the acceptance of the same issued through the shipping confirmation unless by law or decision of government agencies we must make retroactive changes in said policies, Conditions or Privacy Statement, in which case, the possible changes will also affect the orders that you had previously made.

Notifications
All notifications, requests, petitions and other communications that must be made by the parties in relation to these General Conditions must be made in writing and it will be understood that they have been duly made when they have been delivered by hand or sent by ordinary mail to address of the other party or to the latter's email, or to any other address or email that each party may indicate to the other for these purposes.
Applicable law and jurisdiction
These General Conditions are governed by Spanish law.
For consumers residing in Spain, the Spanish Courts and Tribunals shall have exclusive jurisdiction over any issues regarding the interpretation, application, or enforcement of these General Conditions. The user expressly waives any other jurisdiction that may apply under the current Civil Procedure Law.
For consumers residing in other European Union countries, the consumer protection rules of their country of residence shall apply. Nevertheless, Spanish law shall govern these General Conditions in all matters that do not contravene the minimum rights granted by the local consumer law.
For consumers outside the European Union, Spanish law shall govern these General Conditions, and any disputes shall be resolved before the Spanish Courts and Tribunals, unless local law requires another jurisdiction.
Right of withdrawal
You have the right to withdraw from this contract within a maximum period of 14 calendar days without the need for justification.
The withdrawal period will expire 14 calendar days from the day that you or a third party indicated by you, other than the carrier, received the goods.
Shipping costs are exempt from reimbursement as it is a 100% executed service. (Royal Legislative Decree 1/2007, of November 16, art. 103)

Consequences of withdrawal
The term for us to make this return will be a maximum of 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

You can also exercise the right of withdrawal by going to any of our physical stores (UNITED BAGS COMPANY, SL) in which case the exercise of the right of withdrawal will not generate any type of expense for you.
You will only be responsible for the decrease in value of the goods, from the time you receive them until you inform us of the withdrawal, resulting from a manipulation other than that necessary to establish the nature, characteristics and operation of the goods.
The right of withdrawal will not apply to contracts that refer to the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.

Applicable legislation, dispute resolution and competent jurisdiction
These terms and conditions shall be governed and interpreted in accordance with Spanish law.
In case of any dispute or conflict arising from the interpretation or execution of these terms, the competent Courts and Tribunals shall be those applicable under consumer protection laws, particularly the courts of the consumer’s place of residence.
For contracts with users located outside the European Union, Spanish law shall apply unless a mandatory law provides otherwise.
